Powers of Attorney and Guardianship

With many of us living longer, it is to be hoped that retirement and old age can be enjoyed in good physical and mental health, but sadly this is not always the case.  Increasing numbers of our elderly are finding that managing their own affairs can become too much for them. Where this happens it may be possible for an elderly person to sign a Power of Attorney, usually in favour of a close relative.  We strongly recommend to our clients they consider doing so at a young age, to ensure action can be taken immediately if they find themselves unable to manage their affairs in later life.


Where, however, an elderly person is not in a position to grant a Power of Attorney it may be necessary to apply to the court for an Intervention Order or Guardianship authorising a trusted person to be appointed financial and/or welfare guardian.  The responsibilities of a guardian so appointed can be onerous and we offer full financial Guardian services.  Both Guardianship and Continuing Power of Attorney services are overseen by the Office of the Public Guardian.
